Know Your Rights

If the police stop you for a traffic violation:

  • If you have a state-issued driver's license, show it. If you only have a state-issued ID, show it. After identifying yourself, you have the right to refuse to answer questions about your nationality and/or immigration status in the U.S.
  • If you do not have a state-issued ID or driver's license, show your passport or consular ID. After showing your passport or consular ID, you have the right to refuse to answer questions about your immigration status in the U.S.
  • Stay calm and, after receiving the traffic violation, ask if you are free to go. If the police say yes, leave calmly. If the police say no, remain there, but remember that you are not obligated to answer questions about your immigration status in the U.S.

If immigration agents come to your home to detain you due to a deportation order:

  • You do not have to let them in unless they have a judicial warrant signed by a judge. This warrant must have your name and address to be valid. Ask the agents to show you the judicial warrant. Tell them to show it through the window or slide it under the door.
  • It is important to know that a deportation order alone does not give them the right to enter your home. They must have a judicial warrant from a judge with your name and address.
  • If you confirm that they do have such a warrant, you may exit your home. If you have a work permit, receipts, and/or approvals of immigration petitions, it is recommended that you show them and then simply state that you wish to remain silent until you speak with an attorney.
  • If you are detained, you or your family should contact an immigration attorney immediately.

If there is a raid and you believe you are going to be detained and taken to immigration custody:

  • If you have a work permit, receipts, and/or approvals of immigration petitions, it is recommended that you show them and then simply state that you wish to remain silent until you speak with an attorney.
  • If you are detained, you or your family should contact an immigration attorney immediately.
